FDA Investigates the Case of Menthol Cigarettes

Menthol cigarettes became one of the most controversial products ever made by the tobacco manufacturers.

Teenagers are particularly addicted to this product, as nearly 45 % of smokers aged 12 to 17 use menthol cigarettes, according to collected data by the National Survey on Drug Use and Health. About 82.7% of black adult smokers and the majority of black teenaged smokers prefer menthol cigarettes.

“The tobacco producers state that there are no evidences that menthol is more dangerous than other cigarettes, but we don’t agree. More than 80% of African-American smokers prefer menthol cigarettes and researches found out that they have the highest rates of lung cancer,” Ellen Vargyas, general counsel for the American Legacy Foundation, a smoking prevention and cessation organization in Washington, D.C., stated.

“And probably these cigarettes became so popular among younger smokers due to their minty taste, encouraging people to start smoking, perhaps by hiding the harsh taste of regular cigarettes, she added.

The tobacco industry aims its menthol cigarette marketing mostly on young people, according to the National Cancer Institute and the Harvard School of Public Health.

The discussions about menthol cigarettes regulation took place last month during the second round of hearings conducted by the U.S. Food and Drug Administration's Tobacco Products Scientific Advisory Committee.

The consultative commission was established by the Family Smoking Prevention and Tobacco Control Act that was ratified by the President Barack Obama in June 2009. This legislation conferred FDA with powers to limit the marketing of tobacco products.

Within the first round of oral pleading in March, the consultative commission tried to find answers about the addictiveness of menthol cigarettes, whether this tobacco product is more dangerous than conventional cigarettes and whether minty taste encourages teenagers to start smoking.

Anti-smoking advocates stated that there are no evidences that menthol cigarettes that constitute about 33.9 % of the total U.S. cigarette market are less harmful than any other cigarettes. Menthol cigarettes are more addictive, that is why it is harder for smoker to quit, according to a study realized by the University of Medicine and Dentistry of New Jersey.

During the oral pleading representatives of various tobacco manufacturers defended their products, stating that menthol cigarettes are no more dangerous than other cigarettes and they shouldn’t be banned.

“We don’t know any evidence or any suggestion that teenagers would prefer not to smoke if menthol cigarettes were not available. Teenagers smoke not only because there are menthol cigarettes, most probably they smoke due to a variety of reasons that are rather complex,” Bill True, senior vice president of research and development for Lorillard Tobacco Co. stated at the pleading.

Until March 2011 the FDA consultative commission has to report its menthol findings to the U.S. Secretary of Health and Human Services.
